Terms of Service

1. Introduction

Welcome to FranceCloudServer. By accessing, using, or purchasing any of our cloud infrastructure services (Cloud VPS, Managed Cloud, Enterprise Solutions, Domain Registration, or related services), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must immediately cease use of our services.

2. Definitions

  • Service: Any cloud hosting, computing, storage, or domain-related service provided by us.
  • Customer / Client: The individual or legal entity purchasing or utilizing the Service.
  • Account: The digital identity and dashboard used by the Customer to manage and access Services.

3. Eligibility & Account Information

  • Legal Age: You confirm that you are at least 18 years old and possess the legal capacity to enter into a binding contract.
  • Accuracy: You must provide accurate, current, and complete information (Legal Name, Address, VAT number if applicable) during registration.
  • Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

4. Acceptable Use Policy (AUP)

You agree to use the Service only for lawful purposes. Prohibited activities include, but are not limited to:

  • Illegal Content: Hosting or distributing child abuse material, hate speech, or unlicensed copyrighted material.
  • Security Threats: Distributing malware, performing port scans, or initiating DDoS attacks.
  • Spam: Sending unsolicited bulk email (SPAM) from our network.
  • Abuse: Using the service in a manner that negatively impacts our infrastructure or other customers.

5. Payment, Billing, and Renewals

  • Billing Cycles: Services are billed in advance based on the selected term (Monthly, Quarterly, or Annually).
  • Automatic Renewal: To ensure service continuity, subscriptions renew automatically unless a cancellation request is submitted via the client portal prior to the renewal date.
  • Arrears: If an invoice remains unpaid after the due date, FranceCloudServer reserves the right to suspend the Service. Continued non-payment will lead to permanent data deletion.

6. Service Level Agreement (SLA)

While we aim for maximum availability, performance guarantees and remedies for downtime are strictly governed by our SLA Document. No other verbal or written representation shall be deemed a guarantee.

7. Data Ownership and Intellectual Property

  • Customer Content: You retain full ownership of all data, applications, and content uploaded to our servers.
  • Infrastructure: FranceCloudServer retains all rights, titles, and interests in our hardware, proprietary software, and network architecture.
  • License: You grant us a limited, non-exclusive license to host, backup, and transmit your data solely as required to provide the Service to you.

8. Limitation of Liability

  • Indirect Loss: To the maximum extent permitted by French law, FranceCloudServer is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
  • Liability Cap: Our total liability for any claim shall not exceed the total amount paid by the Customer for the specific service during the three (3) months preceding the claim.

9. Termination and Suspension

  • Cancellation: Customers may cancel services at any time via the dashboard. No refunds are provided for partial months unless required by law.
  • Termination for Cause: We may suspend or terminate your account immediately, without notice, if you violate these Terms or our Acceptable Use Policy.
  • Data After Termination: Upon termination, FranceCloudServer is not obligated to maintain your data. We recommend backing up all data before submitting a cancellation request.

10. Modifications

We reserve the right to update these Terms at any time to reflect changes in law or our service offerings. We will notify you of significant changes via email or your account dashboard. Continued use of the Service constitutes acceptance of the modified Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of France. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts located in Paris, France (or the location of our registered headquarters).
